Murder Charges Under Florida Law

Florida Statutes Chapter 782 governs homicide offenses and recognizes several distinct degrees of murder, each with its own elements and sentencing range.

First-Degree Murder

First-degree murder involves either a premeditated killing or felony murder, where death occurs during the commission of a serious enumerated felony. Predicate felonies include robbery, sexual battery, burglary, carjacking, drug trafficking, and aggravated child abuse, among others. A conviction carries life imprisonment without parole or, where aggravating factors apply, such as the victim being under 12 years old or a killing for financial gain, the death penalty.

Second-Degree Murder

Second-degree murder is a killing perpetrated by an act imminently dangerous to another and evincing a depraved mind regardless of human life, without any premeditated design to effect the death of any particular individual. Sentences can reach life imprisonment, with mandatory minimums that may apply depending on the circumstances.

Third-Degree Murder

Third-degree murder occurs when death results during the commission of certain felonies, even without intent to kill, and carries sentences of up to 15 years. A conviction at any degree produces a permanent felony record and forfeiture of certain civil rights.
