What Is Considered a DUI in Florida?

Florida's DUI laws are some of the toughest in the country. If you are pulled over for a traffic violation and suspected of driving under the influence, you can be arrested for a DUI even if you did not commit a separate offense. You can be arrested for a DUI if you:

  • Operate a vehicle on a roadway
  • Are under the influence of alcohol, drugs, or chemicals
  • Have a blood alcohol concentration (BAC) of .08% or greater

If you are arrested for a DUI, you will be required to undergo assessment and treatment. In addition to fines and jail time, you may also be required to attend an alcohol education program.

Penalties for Multiple DUIs

If you are convicted of two DUIs within 10 years, you will be considered a habitual traffic offender. You will be subject to harsher penalties, including license revocation and increased fines.

The penalties for multiple DUI offenses are as follows:

  • Third DUI offense: Up to 5 years in prison and $5,000 in fines
  • Fourth DUI offense: Up to 8 years in prison and $10,000 in fines
  • Fifth or subsequent DUI offense: Up to 10 years in prison and $10,000 in fines

In addition to these penalties, you will be required to attend an alcohol education program. You will also have to install an ignition interlock device (IID) in your vehicle. The IID will prevent your car from starting if you have a BAC of .08% or greater.
