When parents part ways, everyone’s
first thoughts are about how it will affect the children.
After the breakup, the children themselves may fear a drastic
change in lifestyle or having to do without the things they
need. More than anything else, children crave the security
of knowing they will always be loved and provided for. The
purpose of child support is to ensure that children will have
the steady financial resources they deserve.
In Florida, both parents are required by law
to financially support their children. The Florida Department
of Revenue provides some services to enforce child support
payments, but there are many cases in which a parent will
need the services of a child support lawyer. For example,
a child support lawyer can represent a parent if the state’s
guidelines do not provide enough child support. Or, a child
support attorney can petition the court when circumstances
have changed and a parent deserves a different amount of child
support than what is currently being paid. At Tinny, Meyer
& Piccarreto, P.A., our Clearwater,
Florida family law attorneys represent parents throughout
the Tampa Bay area, including Pinellas, Hillsborough, and
Pasco counties, to resolve child support issues. If you feel
that your child support agreement is inadequate or unjust,
we invite you to call a child support attorney, 24 hours a
day, at (727) 446-8600.
The guidelines for child support are outlined
in Florida Statutes. Florida Statues are quite specific in
the amount of child support that should be paid. Parents do
not have the right to refuse child support, as Florida law
considers child support something a child has the legal right
to receive.
The amount of child support is calculated
by adding together both parents’ total net income, and
then figuring out each parent’s percentage of the net
income. For example, typically if one parent contributes 60
percent of the net income, then that parent would be responsible
for 60 percent of the children’s financial support.
The Florida Statutes also contain a table listing the “minimum
child support need” according to the parent’s
level of income and the number of children.
There are many situations, including child
support issues, in which a parent may need to protect his
or her rights by hiring a family law attorney. An experienced
